Prologue

Ternair Software Solutions B.V., after this: “Ternair” or “we”, processes personal data of its (potential) customers and partners. We do this to help our (potential) customers as well as possible and to achieve our objectives.

2holdMore B.V, of which Ternair is part, is responsible for the processing of your personal data. The personal data are available and can be exchanged between all legal entities to the group of companies to which Ternair belongs.

In this privacy statement we explain why and how we process your personal data.

Who is Ternair

Ternair offers powerful marketing automation software to improve and speed up your data-driven business processes. Ternair Marketing Automation platform enables organisations to reach customers at the right time through the most suitable channel, online and offline, with measurable results.

Data Protection Officer

Personal data

Ternair processes your personal data when you are using our products, services and / or because you provide this information to us. This data can be combined with previously obtained data via other Ternair services and / or application forms. Below you will find an overview of the personal data we process among other things:

  • First and last name
  • Address, place of residence
  • Phone number
  • E-mail address, opt-in for e-mailings
  • Gender
  • Company
  • Function
  • Contact history
  • IP address, Cookie ID
  • Date, time, location, internet session
  • Internet browser and device type
  • Fingerprint
  • Interests
  • Surf behaviour
  • If you receive an e-mail from us, we register your interactions (open and click behaviours)
  • Other personal data that you actively provide, for example by signing up for the newsletter, in correspondence and by telephone.

Special and / or sensitive personal data that we process

Our website and / or service does not intend to collect data about website visitors who are younger than 16 years. Unless they have the permission from parents or guardians. However, we cannot check if a visitor is older than 16. We encourage parents to be involved in the online activities of their children, in order to prevent data being collected from children without parental consent. If you are convinced that we have collected personal information about a minor without the permission, please contact us at c.vergeer@ternair.com and we will delete the information.

Purposes for processing

Ternair processes your personal data for the following ends:

  • To handle your registration and / or payment after you have purchased a product or service.
  • To be able to call or e-mail you if this is necessary to carry out our services.
  • To deliver products and services that you have purchased.
  • To inform you about (changes / software updates of) our services and products that you have previously purchased.
  • To inform you about other products or services offered by Ternair.
  • To send the newsletters and mailing for which you have registered.
  • To send invitations to participate in surveys or events related to the Ternair product and service offer.
  • To create an account for you after you have registered yourself.
  • To improve our website based on your surfing behaviour and to adapt our range of products and services to your preferences. We only do this with your permission.

Automated decision making and profiling

Ternair does not use automated decision making and / or profiling. These are decisions taken by computer programs and systems, without a Ternair employee sitting in between.

Principles of processing

Ternair processes your data on the base of the following legal grounds:

  • Performing a legal obligation
  • Entering into or performing an agreement
  • With your permission
  • Performing the justified (marketing) interest: to provide the service you request, to get to know our (potential) customers better and to tailor our offer of the wishes of our target group.

Storage period

Ternair does not store your personal data longer than is strictly necessary. The storage period depends on the purpose for which we have received or collected the data and any legal obligations to retain data. If you have any question about this, you can contact us at c.vergeer@ternair.com.

Sharing personal data with third parties

Ternair never provides, sells, rents or leases your personal data to third parties unless we are legally obliged to provide data, when it is necessary for the execution of an agreement or when you have given permission for this.

We hire service providers for the execution of our services. These are not ‘third recipients’ but ‘processors’. These processors do not use the data for their own purpose and process the personal data exclusively in accordance with the assignment of Ternair. With the companies that process your data, we conclude a processor agreement to ensure the same level of security and confidentially of your data. Ternair remains responsible for these processing operations.

Your personal data will only be processed within the European Economic Area (EEA)

Security

Ternair takes the protection of your personal data seriously and takes appropriate organisational and technical measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorised modification. If you feel that your data is not properly secured or there are indications of abuse, please contact us at c.vergeer@ternair.com.

Ternair has officially received the DDMA privacy quality mark. With this quality mark, we demonstrate that we use personal data in a careful and transparent manner, that we correctly handle personal data that can be used for advertising purposes, and that we act in accordance with all applicable privacy rules. On the basis of an enforcement regulation, the DDMA assesses whether we stick strictly to the strict rules and obligations.

A number of links to other websites can be found on the website of Ternair. Ternair is not responsible for the way in which those organizations process personal data. We advise you to read the privacy statement of the organization in question.

Rights of the involved

Ternair represents all your privacy rights.

Information and insight: You have the right to get information and access the personal data that we process about you. We are happy to tell you how an why we process this data.

Rectification: You have the right to change your data if the data is not (longer) correct. Do you feel that we have the wrong information about you? Let us know so that we can change it.

Oblivion: You have the right to ask us to delete the personal data that we have from you. We may not be able to completely delete your personal data, because we still have to process some data for other purposes. For example like administration or other legal obligations.

Restriction: If you feel that we are processing your personal data unlawful or incorrectly, you can also have that processing limited.

Objection (resistance): You have the right to object against the processing of your personal data. If you object to the use of your personal data to inform you about our activities and similar (“direct marketing”) processing, we always honour this. You can prevent further receipt of (marketing) e-mails from Ternair by clicking on the unsubscribe link in every e-mail you receive from us. Your data will then no longer be used for direct marketing purposes. If you object to other forms of processing your personal data, we will assess whether we can meet your objection.

Transferability: You have the right to transfer your personal information. This means that you can submit a request to us to send the personal information we hold to you or another organization mentioned by you in a standard file format.

Withdraw permission: You have the right to withdraw your consent to data processing. For example, for receiving e-mailings.

Prosecution of rights

You can prosecute your rights by contacting c.vergeer@ternair.com. To ensure that the request had been made by you, we ask you to send a copy of your ID with the request. Make your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (CSN) black, in this copy. This is to protect your privacy. We respond as quickly as possible, but within four weeks, at your request.

Supervisor

Ternair would like to point out that you have the possibility to file a complaint with the national supervisory authority, the personal data authority (PDA), via this form.

Cookies

On the website of Ternair we use cookies, scripts, tage and fingerprints (after this referred to as “cookies”). We do this to improve our services, to ensure that the websites function optimally, for the efficient execution of campaigns and for the purpose as described in this privacy and cookie statement.

A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone when you first visit this website.

Functional cookies
Ternair uses functional cookies to ensure that the website functions properly and that, for example, your preferred settings are remembered. These cookies are also used to make the website work well and to optimize it.

Cookies for statistics and analysis
To determine which parts of the website are the most interesting for our visitors, we use Google Analytics to measure how many visitors come to our website and what is viewed the most. We also use cookies for this purpose.

Statistics are generated from the information we collect. These statistics give us insight into how often web pages are visited, where visitors spend the most time, and so on. This enables us to better align the structure, navigation and content of the websites with the visitors. The collected data is not used for any other purpose than for improving the website. The statistics and other reports cannot be tracked back to persons.

For the analysis we use the services of Google (Google Analytics). Google Analytics is solely responsible for the placement of the cookies and the investigation and analyses of the resulting information. While using the analysis cookies, IP addresses are processed, but we have taken a number of measures to ensure your privacy. For example, we have signed a processor agreement with Google Analytics. It follows that Google acts solely as the processor of the data collected through the cookies. Google does not therefore have an independent right with regard to this data and may not, for example, use this data for its own purposes. We have disabled the ‘share data’ feature. In addition, we have chosen to make the last octet of the IP address invisible.

Tracking cookies
We placed cookies on our website (in the form of a so-called ‘fingerprint’). With it we can monitor and analyse your surfing behaviour on the website and get a (better) picture of the pages you visit and your probable interest. Based on these interest, the content of the website or via other channels can be adjusted. If you have agreed to this, we will combine this information from the cookie with the personal data we have received from you via the website.

Social media cookies
The articles that you view on the website can be shared by means of buttons via social media. The functioning of these buttons uses social media cookies from social media parties such as Facebook, Twitter and LinkedIn, so that they recognize you the moment you want to share an article. Our social media cookies make it possible to: logged in users of selected social media to share certain content directly from our website.

Unforeseen cookies
Due to the way that our website works, it is possible that we do not always have insight into the cookies that are placed on our website. This can occur, for example, in the event that so-called embedded elements (texts, images, films and / or documents stored with another party) are used.
